Silvia Burtea

I am the Director and Founder of Synergy Immigration Solutions Ltd and I was born and bred in Holborn, Central London and now enjoy living in South London. I have over 16 years of experience within the Immigration Industry, having mainly worked within boutique IAA registered companies. I have broad immigration experience with a focus on corporate immigration services which involves assisting businesses to hire overseas migrants to work in the UK. I manage the day to day running of the business and focus on business development and sales and marketing.

After I graduated from Nottingham Law School, I travelled around Asia for a while before embarking on my law career. Over the years I have been fortunate to work in a variety of high street and international city law firms, which has given me a broad depth of experience with different immigration issues and clientele. I handle a variety of corporate matters such as sponsored work visas and sponsor licences. I also handle personal immigration matters such as Post Brexit EEA national applications, Spouse visas, Settlement and British Citizenship.

As a Senior Immigration Adviser based in London, I bring over a decade of experience in immigration law to the organisation. I began working for Synergy Immigration Solutions in June 2024. I have extensive experience across a wide range of immigration and nationality matters with a focus on Business Immigration (PBS Tier 1, Representatives of Overseas Business, Sponsor Licence and Skilled Worker routes). As an immigrant from Romania myself, I possess a first-hand understanding of the challenges confronted by my clients.

Types of Partner Visas:

The UK Partner visa, also known as the Partner or Spouse visa, belongs to the Family visa category and allows non-British partners to live in the United Kingdom with their loved ones. It is designed for individuals who are in a genuine and ongoing relationship with a UK citizen or someone who holds indefinite leave to remain, refugee status, or settled status. This visa ensures couples and families can build their lives together without being separated by immigration barriers.

  • Spouse Visa
  • Unmarried Partner Visa
  • Relationship Visa
  • Civil Partnership Visa
  • Marriage Visa
  • Fiancé Visa

Successful applicants can initially stay for 2 years and 9 months, with the possibility of extending their visa for a further 2 years and 6 months and eventually applying for indefinite leave to remain, after which, they can apply for British citizenship. The Partner visa not only grants the right to live in the UK but also allows visa holders to work and study. This visa category plays a crucial role in supporting family unity, providing a legal pathway for couples to share their lives in the United Kingdom.

UK Partner visa Eligibility Requirements

To qualify for a UK Partner visa, applicants must meet several key eligibility requirements related to their relationship, finances, and personal circumstances.

First, the applicant must be in a genuine and subsisting relationship with a UK citizen, someone with indefinite leave to remain, refugee status, or settled status under the EU Settlement Scheme. The relationship must be either a legal marriage or civil partnership, or an unmarried partnership where the couple has lived together for at least two years. Fiancé(e)s and proposed civil partners can also apply if they plan to marry or enter a civil partnership within six months of arriving in the UK.

Applicants must also prove they have suitable accommodation in the UK that meets housing standards.

For a successful application, the couple must provide extensive evidence to confirm the authenticity of their relationship, including shared financial responsibilities, correspondence, and photographs. If a couple does not live together, they must be able to prove there is a valid reason why, such as due to cultural, work or study-related reasons.

Fiancé(e) visa holders cannot work in the UK until they switch to a Spouse or Partner visa after marriage or civil partnership.

Meeting these eligibility criteria is essential for approval. Failing to satisfy any requirement can lead to refusal, making it important for applicants to prepare thoroughly and seek professional guidance if needed to navigate the process effectively.

There are some additional requirements for the Partner visa to ensure the candidates will settle well into UK society, including:

Additional Requirements

  • The English language requirement
  • The financial requirement

Knowledge of Language and Life (KOLL) Requirement

In certain exceptional circumstances, the UK Home Office may waive or adjust some Partner visa requirements to prevent unjust outcomes or undue hardship. One of the main exceptions applies to the financial requirement.

If the UK-based partner receives specific benefits - such as Personal Independence Payment (PIP), Disability Living Allowance (DLA), or Carer’s Allowance - the applicant is exempt from meeting the standard income threshold. Instead, they must demonstrate "adequate maintenance," meaning their combined income and benefits provide sufficient support without relying on public funds.

Another significant exception arises in cases involving human rights concerns or insurmountable obstacles to living outside the UK. If refusing the visa would cause "unjustifiably harsh consequences" for the couple, the Home Office may exercise discretion. This applies if there are serious health issues, care responsibilities, or other compelling reasons preventing relocation.

Additionally, if a child who is a British citizen or has lived in the UK for at least seven years would be forced to leave or suffer hardship, the Home Office may relax specific requirements. Each case is assessed individually, and strong, well-documented evidence is required to support any claim for exceptional circumstances. These exceptions ensure that the visa process remains fair and considers the unique challenges faced by applicants.

To meet the KOLL requirement, applicants must satisfy two components:

The Knowledge of Language and Life (KOLL) requirement applies to individuals applying for Indefinite Leave to Remain (ILR) or British citizenship in the UK. It ensures applicants can communicate effectively in English and have an understanding of life in the UK. While the KOLL requirement does not apply when initially applying for a UK Partner visa or its extension, it becomes essential when seeking permanent settlement, which becomes possible after living in the UK on a Partner visa for five years.

For the language component, applicants must either pass an approved English test at CEFR level B1 or higher or provide evidence of a recognised degree taught in English. Nationals from majority English-speaking countries, those over 65, and individuals with long-term physical or mental conditions may be exempt.

The second part involves passing the "Life in the UK" test, a 45-minute multiple-choice exam covering British history, traditions, laws, and customs. Applicants must score at least 75% to pass, but the test can be taken multiple times if necessary.

Meeting the KOLL requirement is a crucial step for those wishing to settle permanently in the UK. Proper preparation, including studying the official handbook and ensuring valid language test results, is essential for a successful application. Failing to meet either part of the requirement can delay or prevent the granting of ILR or citizenship, making early planning and preparation vital.

  • English language proficiency
  • Knowledge of life in the UK

Applying for the Partner visa UK

The UK Partner visa application process involves several steps and requires detailed evidence to prove your relationship and eligibility. The process typically begins by completing an online application form on the UK government website. Applicants outside the UK must apply from their country of residence, while those already in the UK can apply to switch to a Partner visa, although the application fee and visa processing times differ.

After submitting the online form and paying the application fee, you will need to book and attend a biometric appointment to provide fingerprints, a photograph, and supporting documents.

The application fee is £1,846 when applying from outside the UK, and £1,258 when applying to switch to a Partner visa from inside the UK.

Processing times vary depending on where you apply from, but standard decisions usually take around 8 to 12 weeks, and priority services provide a faster decision for an additional fee. Throughout the process, applicants must ensure their documents are accurate and meet the Home Office’s requirements. Mistakes or missing evidence can lead to delays or refusals.

Required Supporting Documents:

  • Valid passports for both the applicant and the UK-based partner
  • Evidence of a genuine and subsisting relationship (e.g. marriage certificate, correspondence, joint bank statements)
  • Proof of meeting the financial requirement (e.g. payslips, bank statements)
  • English language proficiency certificate, or valid degree certificate (if applicable)
  • Proof of suitable accommodation in the UK
  • Previous immigration history and visa documents (if applicable)
  • Biometric Residence Permit (for in-country applicants)
  • Any relevant medical exemption evidence (if applicable)
